An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the Friends of South Park to enter onto the County’s South Park for the purpose of constructing a bocce court and two horseshoe pits on Edgebrook Field, with the County to retain ownership of the bocce court and horseshoe pits.

Whereas, the County of Allegheny, on behalf of the Department of Parks, owns and operates certain recreational and park land, including South Park, which includes Edgebrook Field; and
Whereas, the County of Allegheny, on behalf of the Department of Parks, desires to have constructed a bocce court and two horseshoe pits on Edgebrook Field within South Park; and
Whereas, the Friends of South Park (“Friends”) have agreed to construct a bocce court and two horseshoe pits (“the Improvements”) on Edgebrook Field within South Park and to donate the Improvements to the County; and
Whereas, Article IV, Section 2(k) of the Allegheny County Home Rule Charter vests County Council with the power and duty by ordinance to lease or permit the use of County real property; and
Whereas, Article IV, Section 2(j) of the Allegheny County Home Rule Charter vests County Council with the power and duty by ordinance to accept grants or donations of real or personal property.
The Council of the County of Allegheny hereby enacts as follows:
SECTION 1. Incorporation of the Preamble.
The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.
SECTION 2. Authorization to permit the use of County Real Property.
County Council does hereby authorize the Friends to enter onto Edgebrook Field within South Park for the limited purpose of constructing the Improvements.
SECTION 3. Authorization to Accept Improvements.
