An Ordinance delegating to the Commonwealth of Pennsylvania, Secretary of Transportation the right to acquire in the name of Allegheny County right-of-way necessary for a Locally-Owned Multi-Bridge (Bridge Bundling) Project, and to take such further action as may be necessary under applicable law, including the Eminent Domain Code.

Whereas, Pennsylvania Act 89 of 2013 provides a steady funding stream for state and local transportation projects, including Chapter 93, whereby selected local bridges may be rehabilitated or replaced with 100% of the project costs to be borne by the Commonwealth of Pennsylvania using federal funds; and

Whereas, the County Council of Allegheny County deems it advisable to acquire certain right-of-way and easement areas, being required to reconstruct the following four structurally deficient bridges:

Aber’s Creek Bridge No. 2 (AB02), carrying Aber’s Creek Road over Aber’s Creek in the Municipality of Monroeville;
Girty’s Run Bridge No. 10 (GI10) carrying Evergreen Road over Girty’s Run in Shaler Township;
Pine Creek Bridge No. 7 (PI07), carrying Fall Run Road over Pine Creek in Shaler Township; and
Squaw Run Bridge No. 3 (SQ03), carrying Fox Chapel Road over the Glade Run branch of Squaw Run in Fox Chapel Borough;

Said bridgse being collectively designated as Project No. AA15-BNDL, (the “Project”); and

Whereas, by Executive Action No. 6557-15 approved September 18, 2015, Allegheny County entered into the Agreement for Commonwealth’s Performance of Locally-Owned Multi-Bridge (Bridge Bundling) Projects, Reimbursement Agreement No. R15110011, ECMS Agreement No. E03439, MPMS No. 92912, effective January 13, 2016 (the “Agreement”) by which the Secretary of Transportation (“Secretary”) agreed, on behalf of the County and in the County’s name, to complete the Project, including acquiring all right-of-way necessary to construct the Project, with eligible Project costs to be paid 100% by the Commonwealth of Pennsy...
