Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the acceptance of the donation of three thoroughbred horses for adoption by the County for use in the Allegheny County Police’s Mounted Unit.

                     WHEREAS, Bright Futures Farm (“Bright Futures”), a trusted, well-respected 501(c)(3) equine charity and adoption agency located in Cochranton, Pennsylvania, has established the T​ARP (Thoroughbred Advocacy, Retraining & Placement)​ Program under which Bright Futures works with horse trainers and owners at area racetracks to find homes for thoroughbreds who are done with racing and to retrain the horses for other purposes; and 

 

                      WHEREAS, Xpressbet, a horse race wagering service having a place of business at 200 Racetrack Road #26, Washington, Pennsylvania, is the owner of three thoroughbred horses (the “Horses”); and

 

                     WHEREAS, the Horses have been screened through Bright Futures’ TARP Program; and

 

                      WHEREAS, Bright Futures has identified and approved the Mounted Unit of the Allegheny County Police as an appropriate adoptive home for the Horses; and

 

                     WHEREAS, Xpressbet is willing not only to donate the Horses to the County for the County Police’s Mounted Unit but also to pay all expenses related to the County’s adoption of the Horses, including pre-adoption veterinary care, health and wellness certification, provision of current and historical medical records, RFID microchip implantation and national registration, pre-adoption boarding costs, and the cost to transport the Horses to the Allegheny County Police Stables at South Park; and

 

                     WHEREAS, the County Police wish to utilize the Horses as part of its Mounted Unit; and

 

                     WHEREAS, Article IV, Section 2, Subsection j of the County’s Home Rule Charter requires that the Allegheny County Council approve an ordinance authorizing the acceptance of gifts or donations of real and personal property on behalf of the County.

 

                     WHEREAS, Allegheny County Council is of the considered opinion that the acceptance of donation of the Horses from Xpressbet for adoption is in the best interest of the County.

 

The Council of the County of Allegheny hereby enacts as follows:

 

 

SECTION 1.                                           INCORPORATION OF THE PREAMBLE.

 

                                          The provisions set forth in the preamble to this Ordinance are incorporated by reference in their entirety herein.

 

SECTION 2.                                           ACCEPTANCE OF THE DONATION OF PERSONAL PROPERTY.

 

                                          Acting pursuant to Article IV, Section 2, Subsection j of the County’s Home Rule Charter, Allegheny County Council hereby authorizes the acceptance of the donation of three thoroughbred horses described in Exhibit A attached hereto from Xpressbet for use as part of the Allegheny County Police’s Mounted Unit.

 

SECTION 3.                                          AUTHORIZATION OF OFFICERS TO ACT.

 

                                          The appropriate County officers and officials are authorized to take any and all other such action to carry out the purposes of this Ordinance, including the execution of agreements to facilitate the acceptance of the donation of the Horses under such terms and conditions as the County Manager and such other appropriate County officers and officials deem necessary and prudent.

                     

SECTION 4.                                          SEVERABILITY

                     

                                          If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance which shall be in full force and effect.

 

SECTION 5.                       REPEALER

 

                                          Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.

 

SECTION 6.                                          EFFECTIVE DATE.

 

This Ordinance shall enter into effect immediately.
