An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing Townsquare Live Events, LLC to use the outdoor space adjacent to and behind the structure known as the Amphitheatre in the County’s Hartwood Acres Park to conduct an event entitled The Glow Jack-O-Lantern Experience.

Whereas, County Council believes that permitting Townsquare Live Events, LLC to use the designated area in the County’s Hartwood Acres Park for the staging of The Glow Jack-O-Lantern Experience will inure to the benefit of the citizens of Allegheny County; and

Whereas, Article IV, Section 2(k) of the Allegheny County Home Rule Charter vests County Council with the power and duty by ordinance to lease or permit the use of County real estate property.

The Council of the County of Allegheny hereby enacts as follows:

SECTION 1. Incorporation of the Preamble.

The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.

SECTION 2. Authorization for the Use of County Real Property.

A. Allegheny County Council hereby approves the use of the outdoor space adjacent to and behind the structure known as the Amphitheatre in the County’s Hartwood Acres Park by Townsquare Live Events, LLC for purposes of conducting an event known as The Glow Jack-O-Lantern Experience. This authorization is to commence on September 15, 2017, and is to terminate on November 10, 2017.
B. The appropriate County officers and officials are hereby authorized to execute any and all documents necessary to effectuate the purpose of this Ordinance.

SECTION 3. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.
