A Resolution of the County Council of Allegheny County, Pennsylvania, authorizing participation in the 2017-2018 Nursing Home Intergovernmental Transfer Program proposed by the Pennsylvania Department of Human Services; authorizing the transfer of funds as required by the said program and further granting authorization for any and all lawful actions necessary to effectuate Allegheny County’s participation in said program.

Whereas, Allegheny County owns and operates nursing facilities known as the Kane Regional Centers which provide long--term care to the citizens of Allegheny County; and

Whereas, the monies that the Kane Regional Centers receive as reimbursement for the services provided to Medical Assistance (“MA”) program beneficiaries come partly from the Commonwealth and partly from the Federal Government; and

Whereas, the Pennsylvania Department of Human Services has requested that Allegheny County participate in a program known as the 2017-2018 Nursing Home Intergovernmental Transfer (IGT) Program in order to enhance payments and financial support to County nursing facilities and maintain existing nursing facility payment rates, all of which will benefit Allegheny County and the Kane Regional Centers; and

Whereas, the IGT Program contemplates that Allegheny County will make certain intergovernmental transfers to the Commonwealth for FY 2017-2018.

Whereas, Allegheny County agrees to participate in the aforesaid 2017-2018 Nursing Home Intergovernmental Program.

The Council of the County of Allegheny hereby resolves as follows:

 

SECTION 1.                                          Incorporation of Preamble.

 

                                                               The provisions set forth in the preamble to this Resolution are incorporated by reference in their entity herein.

 

SECTION 2.                                          Approval of Participation in Nursing Home IGT Program.                     

                                                               Allegheny County is hereby authorized to participate in the Nursing Home Intergovernmental Transfer program as described and set forth in the Intergovernmental Transfer Agreement between the Pennsylvania Department of Human Services, Office of Long Term Living and Allegheny County (the “IGT Agreement”) and in furtherance thereof, the Chief Executive, the County Manager, the County Council Clerk, the County Solicitor and other appropriate officers of the County are authorized to take any and all lawful actions necessary to effectuate the County's participation in the IGT Program including the provision of County funds in such amounts as may be necessary from time to time to fund the County's percentage share of Intergovernmental Transfers, including, without limitation, by transferring otherwise unrestricted funds from the County’s Pooled Cash, not to exceed $15,100,000.00, and the proper officers of the County are authorized to execute such documents, instruments and agreements necessary to implement the foregoing.

Section 3.                                          SeverabilityIf any provision of this Resolution shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Resolution which shall be in full force and effect.

 

 

 

SECTION 4.                                          Repealer.  Any Resolution or Ordinance or part thereof conflicting with the provisions of this Resolution is hereby repealed so far as the same affects this Resolution.
