Whereas, Mon Yough Community Services is currently using real property in the town of White Oak, and has done so for many years, for the purposes of conducting mental health-related activities, services and special events at a venue known as Angora Gardens; and

Whereas, Mon Yough Community Services wishes to continue to use the real property off of Muse Road without interruption; and

Whereas, Mon Yough Community Services has organized and supervised mental health-related activities for patrons and has maintained and upgraded the structures and surrounding grounds and has been solely responsible for all insurance and required permits, licenses, etc. for related services;

Whereas, County Council believes that permitting Mon Yough Community Services to use the designated area in the County’s White Oak Park for the use as a mental health-service and special event venue will inure to the benefit of the citizens of Allegheny County; and

Whereas, Article IV, Section 2(k) of the Allegheny County Home Rule Charter vests County Council with the power and duty by ordinance to lease or permit the use of County real property.

The Council of the County of Allegheny hereby enacts as follows:

SECTION 1. Incorporation of the Preamble.

The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.

SECTION 2. Authorization to permit the use of County Real Property.

Allegheny County Council hereby approves the continued use of a facility on Muse Road in the County’s White Oak Park by Mon Yough Community Services for a venue known as Angora Gardens.

The term of this authorization begins on April 1, 2018 and continues through March 31, 2021 with the option to extend the agreement until March 31, 2023 at the sole discretion of the County.

The proper officers of the County are hereby authorized to execute any and all documents necessary to effectuate the authorization granted by this legislation.

SECTION 3. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.



SECTION 4. Repealer. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
