An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the acceptance on behalf of the Fifth Judicial District of Pennsylvania - the Allegheny County Court of Common Pleas ("the Courts") of the donation of used desks, conference tables, file cabinets, work stations, movable file storage systems, other office furniture and related personal property for use in the Courts that has been offered to the Courts by various law firms and other organizations.

Whereas, the Courts have contacted law firms and other organizations regarding their willingness to donate used desks, conference tables, file cabinets, work stations, movable file storage systems, other office furniture and related personal property, hereinafter collectively referred to as "Surplus Furniture," to the Courts for use in the Courts; and

Whereas, several law firms and other organizations have responded to the Courts' solicitation and have offered to donate Surplus Furniture to the Courts for use in the Court; and

Whereas, Article IV Section 2(j) of the Allegheny County Home Rule Charter vests County Council with the power to accept by ordinance grants, gifts or donations of personal property on behalf of the County; and

Whereas, County Council previously adopted Ordinance No. 29-14-OR on December 16, 2014, wherein County authorized the County to accept donations of Surplus Furniture on behalf of the Courts during the period from October 2014 through December 2017; and

Whereas, County Council is of the considered opinion that the authorization to accept donations of Surplus Furniture on behalf of the Courts should be continued.

The Council of the County of Allegheny hereby enacts as follows:

 

 

SECTION 1.                     Incorporation of the Preamble.

 

The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.

 

 

 

 

 

SECTION 2.                      Authorization to Accept Donated Surplus Furniture.

 

County Council does hereby authorize the County, on behalf of the Court, to accept donations of Surplus Furniture made on or after January 1, 2018, provided that the Surplus Furniture is inspected and determined by the County Manager or his authorized representative or delegate and the President Judge or authorized representative or delegate to be of appropriate functionality, size and fit for use by the Court.

 

SECTION 3.                     Authorization to Effectuate Ordinance.

The appropriate County officers and officials, including but not limited to the County Manager and the President Judge of the Court, are authorized to take any and all such actions deemed necessary to carry out the intent and purposes of this Ordinance.

SECTION 4.                     Severability.

If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.

SECTION 5.                     Repealer.

Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Resolution.

 

SECTION 6.                     Effective Date.

                     

                     This Ordinance shall enter into effect as of January 1, 2018.
