An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the acceptance of approximately ten acres of land located adjacent to the County’s North Park.

Whereas, The Allegheny Land Trust is the owner of approximately ten acres of land (Parcel 948-L-316) located in the Township of Hampton; and

Whereas, The County, by and through its Department of Parks, is requesting permission to accept the generous donation by the Allegheny Land Trust of real property located near Wildwood Sample Road, adjacent to the County’s North Park; and

Whereas, County Council recognizes that the donation of this property to the County will inure to the benefit of the citizens of Allegheny County; and

Whereas, Article IV, Section 2(j) of the Allegheny County Home Rule Charter vests County Council with the power to accept donation of real property on behalf of the County.

The Council of the County of Allegheny hereby enacts as follows:

SECTION 1. Incorporation of the Preamble.

The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.

SECTION 2. Authorization to Accept the Donation of Real Property.

Allegheny County Council hereby approves the acceptance of the donation of approximately ten acres of land (Parcel 948-L-316) from Allegheny Land Trust located in the Township of Hampton, adjacent to the County’s North Park.

The effective date of this authorization is the date this Ordinance is enacted and is perpetual.

The proper officers of the County are hereby authorized to execute all documents necessary to effectuate the authorization granted by this legislation.


SECTION 3. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.



SECTION 4. Repealer. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
