Whereas, The County owns a structure in West Deer Township in the County’s Deer Lakes Park; and

Whereas, the structure, known as the Deer Lakes Park Administration Building, which functions as an office facility for Deer Lakes Park, is located off of Baileys Run Road, within County Parcel 1514-E-252; and

Whereas, the County’s Department of Parks has concluded that the Deer Lakes Park Administration Office cannot continue to function in its originally prescribed manner and should be demolished and removed from the Park due to its deteriorating and unsafe condition; and

Whereas, Section 5-701.06 of the Allegheny County Administrative Code permits the County to raze or demolish existing building(s) that may no longer be necessary for carrying out its functions under the terms and conditions prescribed and approved by ordinance.

The Council of the County of Allegheny hereby enacts as follows:

SECTION 1. Incorporation of the Preamble

The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.

SECTION 2. Authorization to permit the use of County Real Property

Allegheny County Council hereby approves the demolition and removal of a structure in the County’s Deer Lakes Park.

The term of this authorization begins on February 1, 2019 and continues through December 31, 2020.

The proper officers of the County are hereby authorized to execute any and all documents necessary to effectuate the authorization granted by this legislation.

SECTION 3. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.
