Motion of the Council of Allegheny County pulling Bill No. 11481-20, an Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending and supplementing the Allegheny County Code of Ordinances, Division 5: Health and Sanitation, through the creation of a new Chapter 575, entitled "Paid Sick Days Act," in order to improve the public health by granting paid sick time to employees in the County,” from committee for an immediate final vote.

WHEREAS, Bill No. 11481-20 (attached hereto) was introduced and referred to the Committee on Health and Human Services on April 21, 2020, or 238 days prior to the introduction of this motion; and
WHEREAS, although the Committee on Health and Human Services has met six times during that 238 day span, Bill No. 11481-20 appeared on the Committee’s agenda only once (on June 18, 2020), and while an additional discussion of subject matter relating to the bill was undertaken on October 15, 2020, the bill itself was not on the Committee’s agenda for that meeting, therefore no action could be taken on the bill at that time; and
WHEREAS, pursuant to Section 5-311.04.B. of the Administrative Code of Allegheny County, “County Council shall act on all Ordinances and Resolutions in either the affirmative or negative within 90 days of submittal unless otherwise provided in the Charter or this Administrative Code, or unless tabled by a 2/3 majority of the seated members of Council.”; and
WHEREAS, none of the exceptions established by Section 5-311.04.B. apply to Bill No. 11481-20, and a final vote on the bill thus should have taken place no later than July 20, 2020; and
WHEREAS, the Rules of Allegheny County Council, Article IV, Section B.1.iii., allow for bills to be pulled from committee by the vote of a simple majority of the seated Members of Council if such motion is made more than sixty (60) days from the date of the first reading of the bill;
