Title: Motion of the Council of Allegheny County overriding Chief Executive Rich Fitzgerald's veto of Bill No. 12162-22, entitled “[a]n Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending and supplementing the Allegheny County Code of Ordinances, Division 6, entitled “Parks and Recreation,” through the creation of a new sub Chapter 680, entitled “Certain Agreements Prohibited,” in order to prohibit the leasing, sale and/or any other agreements that would permit or otherwise facilitate private and/or public entities engaging in any industrial or commercial land uses within Allegheny County’s parks."

Motion of the Council of Allegheny County overriding Chief Executive Rich Fitzgerald's veto of  Bill No. 12162-22, entitled “[a]n Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending and supplementing the Allegheny County Code of Ordinances, Division 6, entitled “Parks and Recreation,” through the creation of a new sub Chapter 680, entitled “Certain Agreements Prohibited,” in order to prohibit the leasing, sale and/or any other agreements that would permit or otherwise facilitate private and/or public entities engaging in any industrial or commercial land uses within Allegheny County’s parks."

Whereas, Bill No. 12162-22 was introduced on January 25, 2022; and

 

Whereas, Bill No. 12162-22 was scheduled for committee discussion on June 30, 2022, and a public hearing was held on the bill on June 9, 2022; and

 

Whereas, Bill no. 12162-22 was passed by Council on July 5, 2022; and

 

Whereas, the Chief Executive date stamped his veto of 12162-22 on the morning of July 6, 2022 and delivered it to Council on the evening of July 12, 2022; and

                     

Whereas, pursuant to the Home Rule Charter of Allegheny County, Article IV, §5(b), any action to override this veto must take place “within 30 days of the veto;” and

 

Whereas, it is the judgment of Council that this veto should be overridden; and

 

Whereas, it is accordingly the desire of Council to override Chief Executive Fitzgerald’s veto of bill 12162-22 prior to August 5, 2022 in order to clearly and unambiguously comply with the time limitation found in Article IV, §5(b); and

 

The Council of the County of Allegheny therefore hereby moves as follows:

In accordance with the provisions of Article IV, §5(b) of the Home Rule Charter of Allegheny County, Allegheny County Council hereby overrides Chief Executive Rich Fitzgerald's veto of  Bill No. 12162-22, entitled “[a]n Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending and supplementing the Allegheny County Code of Ordinances, Division 6, entitled “Parks and Recreation,” through the creation of a new sub Chapter 680, entitled “Certain Agreements Prohibited,” in order to prohibit the leasing, sale and/or any other agreements that would permit or otherwise facilitate private and/or public entities engaging in any industrial or commercial land uses within Allegheny County’s parks."
