Motion of the Council of Allegheny County overriding Chief Executive Rich Fitzgerald's veto of Bill No. 12208-22, entitled "[a]n Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending and supplementing the Administrative Code of Allegheny County, Part 4 entitled “Executive Branch,” Article 401, §5-401.09, entitled “Staff organization and appointments” in order to implement a unified structure governing the appointment of departmental directors and equivalent positions."

Whereas, Bill No. 12208-22 was introduced on February 22, 2022; and
Whereas, Bill No. 12208-22 was scheduled for committee discussion four times in March, May, and June of 2022; and
Whereas, Bill no. 12208-22 was passed by Council on July 5, 2022; and
Whereas, the Chief Executive date stamped his veto of 12208-22 on the morning of July 6, 2022 and delivered it to Council on the evening of July 12, 2022; and
Whereas, pursuant to the Home Rule Charter of Allegheny County, Article IV, §5(b), any action to override this veto must take place “within 30 days of the veto;” and
Whereas, it is the judgment of Council that this veto should be overridden; and
Whereas, it is accordingly the desire of Council to override Chief Executive Fitzgerald’s veto of bill 12208-22 prior to August 5, 2022 in order to clearly and unambiguously comply with the time limitation found in Article IV, §5(b); and
The Council of the County of Allegheny therefore hereby moves as follows:
In accordance with the provisions of Article IV, §5(b) of the Home Rule Charter of Allegheny County, Allegheny County Council hereby overrides Chief Executive Rich Fitzgerald's veto of Bill No. 12208-22, entitled "[a]n Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending and supplementing the Administrative Code of Allegheny County, Part 4 entitled “Executive Branch,” Article 401, §5-401.09, entitled “Staff organization and appointments” in order to implement a unified structure governing the appointment of departmental directors and equivalent positions."
