An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, authorizing the acceptance of a donation to the County of approximately one-half acre of land located contiguous to the County’s White Oak Park.

Whereas, Paulette Flaherty is the owner of an approximately one-half (1/2) acre parcel of land located along McClintock Road in the Borough of White Oak identified in the Allegheny County Office of Deed Registry as Block 649-J, Lot 287 (the Property); and

Whereas, the Property is contiguous to the County’s White Oak Park; and

Whereas, Ms. Flaherty has contacted the County’s Department of Parks and has offered to donate the Property to the County to expand White Oak Park; and

Whereas, the County’s Department of Parks is requesting County Council’s approval to accept Ms. Flaherty’s generous donation of the Property; and

Whereas, County Council is of the opinion that the acceptance of the donation of the Property and incorporating it into the County’s White Oak Park will inure to the benefit of the citizens of Allegheny County; and

Whereas, Article IV, Section 2(j) of the Allegheny County Home Rule Charter vests County Council with the power to accept a donation of real property on behalf of the County.

The Council of the County of Allegheny hereby enacts as follows:

SECTION 1. Incorporation of the Preamble.

The provisions set forth in the preamble to this Ordinance are incorporated by reference as set forth in their entirety herein.

SECTION 2. Authorization to Accept the Donation of Real Property.

Allegheny County Council hereby accepts Paulette Flaherty’s donation of an approximately one-half (1/2) acre parcel of land identified as Block 649-J, Lot 287 and its incorporation as a perpetual part of County’s White Oak Park.

The proper officers of the County are hereby authorized to execute all documents necessary to effectuate the authorization granted by this legislation.

SECTION 3. Severability. If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.

SECTION 4. Repealer. Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.

SECTION 5. Effective Date. This Ordinance shall enter effect immediately upon its approval.
