An Ordinance of the County of Allegheny, Commonwealth of Pennsylvania, amending Article 207 of the Administrative Code of Allegheny County, entitled “New Board of Property Assessment Appeals and Review,” §5-207.03 “Qualifications of Board Members; appointment; terms; organization of Appeals Board,” in order to provide for periodic adjustment of Board Members’ annual per-meeting stipend limitation.

WHEREAS, pursuant to the terms of §5-207.03.H. of the Administrative Code of Allegheny County, the members of the Board of Property Assessment Appeals and Review (“BPAAR”) are to be paid per-meeting stipends in amounts established by County Council via Resolution, in an amount not to exceed nine thousand dollars $9,000 per member per year; and

 

WHEREAS, the annual limitation contained within §5-207.03.H. has not been changed since the provision was originally enacted in 2000 (See, ordinance 15-00-OR, income limitation enacted as §5-207.03.I); and

WHEREAS, it is the judgment of Council that an increase in the annual limitation contained within §5-207.03.H. is appropriate; and

WHEREAS, it is further the desire of Council to establish a mechanism through which periodic adjustments to the annual per meeting stipends received by the BPAAR members are accomplished.

The Council of the County of Allegheny hereby enacts as follows:

 

SECTION 1.  Incorporation of the preamble.

 

The preamble to this Ordinance is hereby incorporated in its entirety herein.

 

SECTION 2.  Amendment of the Administrative Code.

The Administrative Code of Allegheny County, §5-207.03, entitled “Qualifications of Board Members; appointment; terms; organization of Appeals Board,” is hereby amended as follows:

H.                     County Council shall establish by Resolution a per meeting stipend to be received by the members of the Appeals Board not to exceed in the aggregate $9,000 annually per member.

Members of the Appeals Board shall receive a per meeting stipend not to exceed in the aggregate $10,939 annually per member. Thereafter, the annual per meeting stipend aggregate limit for Board members shall not exceed the annual per meeting stipend aggregate limit for members of Allegheny County Council, as established in §5-301.09.B of this Administrative Code.

SECTION 3.  Severability.

 

If any provision of this Ordinance shall be determined to be unlawful, invalid, void or unenforceable, then that provision shall be considered severable from the remaining provisions of this Ordinance, which shall be in full force and effect.

 

 

SECTION 4.                      Repealer.

 

Any Resolution or Ordinance or part thereof conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.

 

 

SECTION 5.  Effective Date.

 

This Ordinance shall become effective January 1, 2023.
